The Clarity Act: the new narrative of the cryptocurrency market ⚖️

Markets sometimes do not move on reality; they move on narrative. The “Clarity” Act, too, is not yet a legal reality, but a narrative that capital is already pricing in. The difference between the two is the same gap that exists between the map and the territory. Many forget this gap and pay the price for it.

Today, this law has not yet been born. It has only passed through a few gates. A version of it previously passed the House of Representatives, the Senate Banking Committee has also approved it, and it is now awaiting a final vote on the Senate floor. But until the final vote is taken, the differences between the House and Senate versions are resolved and the President's signature is put on it, nothing has changed legally. The market trades the future; the law only changes the present.

Time may be the most important player in this story. The Senate's return in mid-July has created a short window before the August recess. Many analysts consider this period the last serious opportunity to pass the law in 2026. If this window closes, it may take years for such a consensus to form again. In politics, as in astronomy, a small alignment sometimes changes the fate of a planetary system.

But every law, before it is written on paper, is a battlefield of interests. Three knots have not yet been untied. First, concerns about conflicts of interest and preventing officials and their families from profiting from digital assets. Second, disagreement over the powers of judicial bodies and whether certain legal provisions tie prosecutors' hands in pursuing financial crimes. Third, the competition between traditional banks and the stablecoin economy, where billions of dollars in annual revenue change hands over a few legal clauses. This debate is no longer about technology; it is about the distribution of power.

That is why the probability of passage should not be mistaken for certainty. Some institutions consider passage more likely than failure, while others assess the chances as roughly even. A professional investor invests on “probability,” not on “hope.”

If this law reaches its destination, the biggest change will be the end of years of ambiguity. The boundary between SEC and CFTC jurisdiction will become clearer, and digital assets will be classified based on their actual function, not merely on the label attached to them. A project that was once born like a security could, upon reaching true decentralization, become a digital commodity in the future. This change resembles the maturation of a living organism; a cell that was once dependent reaches a point where it can breathe independently.

At the heart of this transformation, the DeFi ecosystem also gains more breathing room. Developers, validators and open-source protocols will not be treated as brokers merely because they build infrastructure, although anti-fraud laws will remain in place. On the other hand, after the bitter experience of FTX, separating customer assets from company capital becomes a requirement; a principle that should have been self-evident in financial markets, but sometimes a crisis is needed for the obvious to be rediscovered.

Another part of this law changes the outlook of financial institutions. Many funds and large companies have stayed on the sidelines not because they oppose blockchain, but because of legal ambiguity. For institutional capital, the absence of law is more dangerous than the law itself. Clarity, if achieved, may be the very bridge that big capital has been waiting years to see built.

In such a scenario, some assets will attract more attention than others. XRP may be the most direct beneficiary, as legal clarity could reduce years of ambiguity surrounding its status. Solana, given its position in DeFi, staking and real-world assets, will also benefit from an environment with clearer rules. Hyperliquid represents a new generation of protocols that have entered the competition without old regulatory cases and will have an opportunity to grow if American capital returns to DeFi. Alongside them, projects such as LINK, XLM, ADA and HBAR are also being closely watched by investors because of their infrastructure or payment-network roles.

A similar story is unfolding in the stock market. Circle is almost a picture of the stablecoin economy; the more legitimacy this sector gains, the stronger its position becomes. Coinbase is not only an exchange but also one of the most important custodians of digital assets for ETFs and financial institutions, and it will benefit from any step that increases legal certainty
